The Terra app, website, and all related services are operated by Daydream Studios LLC dba Terra (“Terra,” “Company,” “we,” or “us”).

PLEASE READ CAREFULLY:
By downloading, accessing, or using Terra, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree, do not use the app or website.
These Terms apply to users in the United States and are governed by the laws of Arkansas.
MANDATORY ARBITRATION:
These Terms include an agreement to binding individual arbitration and a class-action waiver. See Section 10.
1. Definitions
- App: The Terra mobile application and all associated pages, screens, and features.
- User: Any individual using Terra, free or Premium Version.
- Contributor: A User who submits or edits content within Terra.
- Customer: A User who purchases the Premium Version or in-app features.
- Premium Version: Paid subscription or in-app content/features available in Terra.
- Database: Collection of products and related information accessible through Terra.
- Products: Food, beverage, or other items analyzed or tracked in the Database.
- Services: Analysis, evaluation, scanning, recommendations, or other functionality provided by Terra.
2. Terra’s Mission and Independence
2.1 Mission:
Terra empowers users to make holistic, informed decisions about the foods and products they consume, focusing on health, nutrition, and sustainability.
2.2 Independence:
- Terra operates independently and is not influenced by brands or manufacturers.
- We do not display advertisements, accept payments to influence product rankings, or sell personal user data.
- Paid Premium Versions fund the operations of Terra and ensure impartiality of content.
3. How Terra Works
3.1 Database:
- Terra’s Database is maintained using official sources, internal research, and verified Contributor submissions.
- While we strive for accuracy, completeness cannot be guaranteed. Users are responsible for verifying critical information, particularly regarding allergens or dietary restrictions.
3.2 Ratings and Recommendations:
- Terra uses a proprietary algorithm to score products based on nutritional content, additives, and holistic health factors.
- Scores and recommendations are opinions only and are not medical advice. Users should consult healthcare professionals for medical guidance.
3.3 Contributor Content:
- Users may submit product information, corrections, or reviews.
- Contributors grant Terra a worldwide, royalty-free license to use submitted content in any medium.
- Deliberate submission of false information may result in account suspension and legal action.
3.4 Premium Version:
- Features include offline scanning, advanced product search, and custom dietary preferences.
- Purchases are processed via app stores or Terra’s website.
4. Account Management
4.1 Creating an Account:
- Users must provide accurate information and secure their login credentials.
- Only one account per person is permitted unless expressly authorized.
4.2 Suspension or Deletion:
- Accounts may be suspended or deleted for violations of these Terms, inactivity, or at our discretion.
- Terra is not liable for damages resulting from account suspension or deletion.
4.3 User-Initiated Closure:
- Users may delete their account at any time by following the in-app procedure or contacting support@getterra.app.
5. User Rights and Obligations
5.1 Restrictions: Users agree not to:
- Post illegal, offensive, defamatory, or harmful content.
- Interfere with app operation, including hacking, scraping, or malware distribution.
- Share accounts or collect information from other users without consent.
- Falsely modify product information.
5.2 Contributions:
- By submitting content, Contributors waive claims to ownership for use by Terra, including commercial use.
- Contributors must only submit content they own or have permission to use.
5.3 Reviews, Ratings, and Suggestions:
- Users may submit reviews, ratings, and suggestions to improve Terra.
- Submissions must be truthful and lawful; abusive submissions may result in account suspension.
6. Liability and Warranties
6.1 General Use:
- Terra is provided “as is” without warranties of any kind.
- We do not guarantee complete accuracy, relevance, or reliability of product data.
6.2 Health and Medical Disclaimer:
- Terra does not provide medical advice and is not a substitute for professional consultation.
- Users must not rely solely on Terra for health or dietary decisions.
6.3 Limitation of Liability:
- To the fullest extent allowed by law, Terra and its affiliates are not liable for direct, indirect, incidental, special, or consequential damages arising from use of Terra.
- For Premium Version users, total liability is limited to the amount paid for the subscription; for free users, liability is limited to $100.
7. Intellectual Property
7.1 Terra’s Rights:
- Terra owns all content, software, algorithms, and branding. Users are granted a limited, personal, non-transferable license to use the App.
- Copying, reverse-engineering, or redistribution of Terra content is prohibited.
7.2 Third-Party Rights:
- Users must respect copyrights, trademarks, and other rights of third parties displayed in Terra.
8. Purchase of Premium Version
8.1 Subscription Terms:
- Premium subscriptions are billed annually and renew automatically unless canceled prior to renewal.
8.2 Pricing and Payment:
- Prices are in USD and include applicable taxes.
- Payment is processed securely via app stores or Terra’s website.
8.3 Cancellation:
- Users may cancel at any time; access continues until the end of the current subscription period.
9. Modifications, Severability, and Tolerance
- Terra may update these Terms at any time. Continued use constitutes acceptance.
- If any part of the Terms is invalid, the remainder remains enforceable.
- Tolerance of violations does not waive Terra’s rights.
10. Dispute Resolution
10.1 Informal Resolution:
- Users must first notify Terra of disputes by email to support@getterra.app.
10.2 Binding Arbitration and Class Action Waiver:
- Unresolved disputes will be resolved by binding arbitration in Arkansas, under AAA rules.
- Users waive the right to participate in class actions.
- Users may opt out of arbitration within 30 days by notifying Terra in writing.
